Pursuant to a Default Judgment In Rem and Summary Judgment and Order of Sale entered on October 7, 2011, by the Pulaski Circuit Court, Division II, in Civil Action No. 11-CI-00700, the Master Commissioner of the Pulaski Circuit Court will sell at public auction to the highest and best bidder the real property described as follows:
Lots 29 and 31 in the Willow Oak Subdivision, being more particularly described by a plat of record in Plat Cabinet C, Slide 25, and by deed of conveyance of record in Deed Book 707, Page 422, and Deed Book 797, Page 404, all of record in the Pulaski County Clerk’s Office, Kentucky.
DATE OF SALE: Thursday, January 5, 2012, at 1:00 p.m., local time.
PLACE OF SALE: At the property located at 35 Doe Run, Nancy, Kentucky.
The real property shall be sold to the highest bidder on terms of full cash price on date of sale, or at purchaser’s option, ten (10%) percent of the purchase price in cash at the time of the sale and the balance payable within thirty (30) days with the purchaser being required to execute bond with surety approved by the Commissioner to secure the unpaid balance of the purchase price; the said bond shall bear interest at the rate of twelve (12%) percent per annum until paid. The bond shall have the force and effect of Judgment and shall be and remain a lien upon the property sold as additional surety for the payment of the purchase price.
Risk of loss of improvements shall be on the purchaser from date of sale.
The property shall otherwise be sold free and clear of any right, title and interest of all parties to the action and of their liens and encumbrances thereon, excepting easements and restrictions of record in the Pulaski County Clerk’s Office and such right of redemption as may exist in favor of the parties to the above lawsuit.
The amount to be raised from the sale of this property is $43,655.97, plus interest, costs, and attorney fees and any ad valorem property taxes.
The purchaser shall be required to assume and pay all taxes or assessments upon the property for the current tax year (2012) and all subsequent years. All taxes or assessments upon the property for prior years shall be paid from the sale proceeds, if properly claimed in writing and filed of record by the purchaser prior to payment of the purchase price.
Bidders shall be prepared to promptly comply with the aforesaid terms and conditions.
